USCIS Reaches FY2019 H-1B Cap

USCIS announced that – during the period between April 2 and April 6, 2018 – it received a sufficient number of H-1B petitions to exhaust both the congressionally-mandated 65,000 H-1B cap for FY2019 and the 20,000 H-1Bs available under the advanced-degree cap exemption. Because the number of FY2019 H-1B petitions received during the FY2019 filing window exceeds the cap, USCIS will administer a lottery to select FY2019 H-1B petitions for processing. USCIS will continue to accept and process petitions that are exempt from the cap, petitions for H-1B workers who have been counted previously against the cap, as well as H-1B petitions filed to extend or amend H-1B status, change H-1B employers, or work concurrently for a second H-1B employer.
