Employees who need to take time off from work for any number of reasons enjoy significant protection under federal, state, and sometimes even municipal law. Navigating this complex area of the law remains challenging, as various leave laws are typically enacted without much consideration for how they interact with other laws. And, despite the drafters’ good intentions, it is impossible to anticipate how leave requirements will actually work in the real world.

Because these vexing issues continue to create significant legal risk for employers, we will again devote a half-day program to this important topic. We’ll cover a lot of ground in mostly short, faced-paced presentations designed to get you up to speed and up to date:

  • "How do I leave thee? Let me count the ways:” A review of workplace leave
  • The Trinity: Workers Comp, FMLA, and ADA
  • Here today, gone tomorrow: the challenges of intermittent leave
  • FMLA and the Goldilocks principle
  • Leave and STD are not the same thing
  • Exploring the limits of leave as a disability accommodation
  • Medical exams – who, what, when, where, how?
  • Attendance policies you can safely enforce
  • Impact of leave on benefits administration
  • USERRA refresher
  • Pregnancy after Young v. UPS
  • Risks and benefits of using third party vendors to administer leave programs
  • Leave in the real world – break-out sessions to practice applying what you’ve learned to actual situations
