Another Federal Court Rejects DACA Rescission

The United States District Court for the District of Columbia issued an order in NAACP v. Trump vacating rescission of the DACA program, finding that, under the federal Administrative Procedure Act, the DHS rescission of the DACA program was arbitrary and capricious. The court ordered DHS to accept and process new and renewal DACA applications. The court, however, stayed implementation of its order for 90 days to allow DHS to “better explain” its rescission of DACA. The decision in NAACP v. Trump follows earlier decisions by federal district courts in New York and California that have also stayed DHS rescission of the DACA program.
