After years of discussion, debate, and different proposals, Massachusetts has adopted a new law that makes non-compete agreements harder to execute, more limited in scope and duration, and more expensive for employers. The new law goes into effect on October 1, 2018. After October 1, 2018, all new non-compete agreements in MA must meet the new requirements. Fortunately, the new law does not affect non-disclosure and non-solicitation agreements.
