Environmental due diligence is critical to understanding a project's risk, financial underwriting, and environmental compliance and sustainability. This course is designed to help commercial real estate professionals navigate this vital aspect of the asset investment and development process. 

Attendees will learn how early collaboration between technical and legal teams can help identify hidden risks, negotiate stronger contractual protections, and structure transactions to avoid costly surprises.

This program will focus on:

  • Executing Phase I and Phase II environmental site investigations
  • Identifying and addressing contamination issues, ensuring regulatory compliance
  • Understanding legal mechanisms such as indemnities, environmental representations and warranties, and contractual risk-shifting provisions
  • Leveraging attorney–consultant collaboration to strengthen due diligence outcomes and transaction success
  • Integrating environmental and legal considerations seamlessly into decision-making frameworks

Michelle O'Brien has more than 30 years of experience handling environmental and land use permitting and related litigation for various types of developments, including residential homes, commercial buildings, waterfront properties, and solid waste facilities. Michelle often conducts environmental due diligence for real estate and business transactions, including the financing and development of renewable energy facilities such as battery energy storage systems and solar farms.
