Lawyers play a key role in guiding clients through the environmental due diligence process, which is needed to assess potential liabilities associated with a property or business transaction. This is particularly important in Massachusetts due to its "status liability" laws, which can hold owners and operators responsible for environmental contamination even if they are not the cause of any contamination. Pierce Atwood environmental, land use, and litigation attorney Michelle O’Brien will ask the students what they know about the laws that should be considered in conducting environmental due diligence and then guide them through the process.

She often conducts environmental due diligence for real estate and business transactions, including the financing and development of renewable energy facilities such as battery energy storage systems and solar farms.
