Donald G. Lussier

Don Lussier has extensive experience representing sponsors, investors, and lenders in connection with virtually all types of commercial real estate assets throughout the United States, including multifamily complexes, office buildings and parks, industrial buildings, hospitality properties including hotels and golf courses, shopping centers, and self-storage facilities.

Don provides legal guidance to his clients on all aspects of their businesses, including acquisitions, raising capital, financings, leasing, land use matters, dispositions, and operational issues. In addition, Don has a great deal of experience negotiating joint venture agreements between sponsors and private equity real estate investors, and in connection with private placements raising equity for real estate acquisitions.

On the lending side, his experience includes representing both borrowers and lenders on bridge and permanent mortgage loans, construction loans, CMBS loans, and mezzanine financings. Don has also drafted and negotiated intercreditor, participation, syndication, and note purchase agreements, and has represented both borrowers and lenders in workout and debt-restructuring arrangements.

In his business practice, Don has counseled companies in myriad industries in general corporate governance matters. He has negotiated joint venture agreements in a variety of commercial contexts, merger and purchase and sale agreements, venture capital investments (from both the investor and company sides of the table), operating and shareholder agreements, licensing arrangements for patents and other types of intellectual property, and a variety of other contractual matters.

Before joining Pierce Atwood, Don was a partner in the Real Estate Practice Group at Saul Ewing LLP. Before that he was general counsel of Sawyer Realty Holdings LLC, a privately held, fully integrated real estate investment and management company specializing in the multifamily sector.
