Supreme Court Upholds Travel Ban

The United States Supreme Court upheld President Trump’s September 24, 2017 Presidential Proclamation (Travel Ban 3.0) by a vote of 5 to 4, allowing the travel ban to remain in effect (Trump v. Hawaii). Writing for the majority, Chief Justice Roberts held that Travel Ban 3.0 is a lawful exercise of the broad discretion granted to the President under Section 1182(f) of the Immigration and Nationality Act. Justices Kennedy, Thomas, Alito, and Gorsuch joined Chief Justice Roberts. Justice Breyer filed a dissenting opinion, in which Justice Kagan joined. Justice Sotomayor filed a dissenting opinion, in which Justice Ginsburg joined.
