Suzanne King, a partner in Pierce Atwood’s Employment Practice Group, and an advisor to nonprofits on employment law, discusses some of the do’s and don’ts of using social media in screening or conducting background checks of potential job candidates.

Suzanne advises clients to remain aware that the “Fair Credit Reporting Act (FCRA) may apply if they outsource social media screening.” She recommends that the human resources department conduct social media screenings rather than the hiring manager, and to check public sites only. And to “refrain from asking candidates to provide passwords to view private content.”
