We represented Southwest Windpower with regard to small-scale wind turbines.

Fox Islands Wind, LLC
We serve as general counsel to this successful community wind project located in Vinalhaven, an offshore island off the coast of Maine.  The three wind turbine project is a successful innovative initiative supported by the Island's consumer-owned electric utility, non-profit institutions, and private investors, who have cooperated to develop an indigenous source of power to secure a reliable and affordable source of electricity supply for the islanders.  Our representation extends to all aspects of project development, including corporate governance and contracts, project finance (including both public and private sources of funding), real estate, environmental and land use authorizations, and utility authorizations.

Tidal Power Trials off Maine Coast
We serve as general counsel to Ocean Renewable Power Company, a tidal power R&D and project development company, including successful applications for FERC and state environmental authorizations for now completed product trials in Western Passage off the Maine coast.

FERC Licensing for Hydropower Projects
We represented FPL Energy, Brookfield Power, Madison Paper, Synergics, BayCorp, Domtar, and Bowater in the FERC licensing, settlements, and dam removal proceedings for hydropower projects in Maine, New Hampshire, Vermont, Massachusetts, and Washington states.

Water Quality Certifications at Hydropower Projects in Maine
We represented S.D. Warren, FPL Energy, Brookfield Power, Domtar, Synergics, and Ridgewood Renewable Power, LLC in water quality certification proceedings, including reopened proceedings for fish passage, for hydropower projects in Maine.

Purchase and Sale or Financing of Hydro Projects in Four New England States
We represented Brookfield Power, Madison Paper, FPL Energy, and BayCorp in the purchase and sale or financing of hydro projects in Maine, Massachusetts, Vermont, and New Hampshire.

Development of Gas-to-Energy Sites
We represent and advise landfill owners in the development of gas-to-energy sites where methane is extracted from the landfill and used to generate electricity.

Co-Gen Biomass Boiler for Fuel Production
We represented Georgia-Pacific in Old Town, Maine and S.D. Warren in Westbrook, Maine to allow environmental permitting for the use of construction and demolition debris wood chips as fuel in the new co-gen biomass boiler for Georgia-Pacific and the existing co-gen biomass boiler for S.D. Warren.

Pipeline-Grade Biogas Projects
We represent a company that develops, owns and operates renewable gas facilities in all aspects of negotiating and documenting the siting, supply, offtake and financing of their renewable energy projects, which produce biogas, pipeline-grade methane and carbon sequestration credits from livestock and food industry waste streams by utilizing an advanced anaerobic digestion technology.

Fuel Cubes as Fuel in Existing Co-Gen Biomass Boiler
We represented S.D. Warren in Somerset, Maine in the environmental permitting of use for fuel cubes as fuel in existing co-gen biomass boiler.

New Biomass Boilers to Generate Electricity for Greenhouses
We represented Backyard Farms in the environmental permitting of new biomass boilers to generate electricity and heat for large commercial greenhouses to grow tomatoes hydroponically. Carbon dioxide generated by boilers to be used in greenhouses to help grow tomatoes.

Primary Power International
We represented the monetization of 18 MW open loop biomass powered electric generating facility located in Hillman, MI developed by Primary Power International.

Wood Fueled Facilities Developed by Boralex Industries, Inc.
We represented the monetization of wood fueled electric power generating facilities in Maine and New York developed by Boralex Industries, Inc.

For over a dozen years, a partner in our Energy Practice Group has provided corporate and regulatory counsel to a large, Boston-based banking institution in connection with the monetization of federal and state income tax credits associated with a wide variety of energy projects.

FERC Certification of Renewable Tax Credits
We represented Madison Paper, BayCorp, and Brookfield Power in the FERC certification of renewable energy tax credits in Maine and New York.  

Domestic Policy Development
Pierce Atwood is deeply involved with policy formation and development supporting and enhancing the success of renewable energy development.

For example:

We represented Linekin Bay in the development and implementation of Geographic Information Systems used for renewable production verification and the legislative issues of concern.

We represented Maine's largest papermaker in sustainable forest policy development and sustainable forestry certification policy development.

We represented Casco Bay Energy and Maine's largest papermaker to assess impacts and develop comments during development of Department of Environmental Protection's RGGI program and legislation.

We represent a large national trade association which is active on policy formation surrounding alternative fuels and biofuels laws and regulations.

Development Work
Pierce Atwood works under international development contracts funded by the World Bank, USAID and SIDA to further the use of renewable energy in developing and transitional economies around the world. We apply our legal and technical knowledge of renewable energy to assist governments and regulators implement sustainable energy frameworks.

For example:

In Kosovo, as part of our multi-year effort to build the capacity of the energy regulator, we offered legal advice on Kosovo's first efforts to certify green energy, in anticipation of a growing renewables market.

In Moldova, we are currently leading the legal team to design a feed-in tariff methodology and develop renewable power purchase agreements.

In the Republic of Georgia, we are working with government officials to develop an energy efficiency law and a law on renewable energy.

We are currently under contract with The European Bank for Reconstruction and Development (EBRD) to conduct a regional power assessment, including a renewable energy and energy efficiency analysis of 30 countries, including European member states, South East and Eastern Europe, Russia and Central Asia.

Transactional Work
We represent companies seeking to invest overseas. Most recently, we completed a legal due diligence for a renewable energy investor in the Caucauses.

We represent the Ministry of Energy and Mining Resources in the Hashemite Kingdom of Jordan with respect to all aspects of the tender process, drafting and negotiation of documents to support Greenfield renewable and other power plant investment in Jordan.

For Saudi Electric Company, we are presently engaged in power supply diversification efforts, including more efficient and environmentally sound cogeneration, heat recovery, and multiple fuel use projects. We also are negotiating and drafting long term project finance agreements to support diversified, environmentally sound generating sources within the Kingdom of Saudi Arabia.
