Previously Submerged Land Automatically Registered to Parcel: Don Pinto Quoted in Massachusetts Lawyers Weekly

Don Pinto real estate and land use lawyer BostonIn a case of first impression, an Appeals Court has ruled that “previously submerged land on Cape Cod that accreted to property owners as the shoreline receded automatically became registered to the owners, which protected the parcels from prescriptive easement claims.”

Pierce Atwood real estate and land use partner Donald R. Pinto, Jr. called it a “close case,” but that “the majority was correct.” He added, “Private ownership of oceanfront land extends to the low water mark, which, as the majority points out, is constantly changing.”
