Preserving the View

Pierce Atwood represented the trustees of the Doris Homer Trust, including investment company H.M. Payson, which owned the oceanfront property. Following the purchase, the museum placed the oceanfront property into a conservation easement. 

Pierce Atwood worked with H.M. Payson, beginning in 2010, to resolve a dispute regarding potential use of the oceanfront property, beginning with Town of Scarborough board proceedings, through administrative appeals to Maine Superior Court and the Maine Supreme Judicial Court, a subsequent civil lawsuit, and mediation, and then the recent final real estate transaction. The successful sale, for $2.3 million, resolved the dispute.
