Jared's practice focuses on complex energy litigation and regulatory matters before the Maine Public Utilities Commission ("MPUC"), the Federal Energy Regulatory Commission ("FERC") and state and federal courts around the country.
In each of his cases, Jared strives to develop a comprehensive strategic plan for success in collaboration with his clients and then to efficiently implement that plan through discovery, motion practice and ultimately trial in order to achieve his clients' business, regulatory and policy goals in the most cost effective manner possible.
Jared has broad experience on energy regulatory matters including representation of clients with respect to issues of rate recovery and design, ISO/RTO participation and market design, transmission development, nuclear decommissioning, power purchase agreement disputes and smart grid implementation.
Recent Experience
In recent years, Jared has successfully served as lead counsel on several major energy regulatory and commercial disputes in Maine, Utah, California and Washington, DC. Recent examples of Jared's successes include:
- Representation of Maine's largest transmission and distribution utility in:
- Obtaining a Certificate of Public Convenience and Necessity Proceeding for the Maine Power Reliability Program, a $1.4 billion transmission upgrade across the State of Maine (MPUC Docket No. 2008-255)
- Opposing the withdrawal of the State of Maine from ISO-NE (MPUC Docket No. 2008-156)
- Participating in on-going Maine PUC investigation of transmission planning criteria (MPUC Docket No. 2011-494)
- Representation of power marketers in overturning decision of The Electric Reliability Council of Texas (ERCOT) to resettle prices for congestion revenue rights before the PUC of Texas (PUCT Docket No. 39433)
- Representation of The Canyons ski resort in Park City, Utah in a breach of contract dispute in Utah State Court that resulted in a $54.4 million verdict, one of the largest in Utah history, for Jared's client
- Representation of New York State Electric & Gas Corporation (NYSEG) before Bankruptcy Court, FERC and the New York PSC concerning the threatened abandonment of coal fired generation facilities in upstate New York by AES affiliates (Bankr. D Del. Case No. 11-14138)
- Representation of the State of California in a $4 billion challenge to a series of long-term energy contracts on the State's behalf before the FERC, the appeal of which was decided in the State's favor by the Ninth Circuit, 474 F.3d 587 (2006) and, most recently, the United States Supreme Court (Morgan Stanley Capital Group Inc. v. Public Utility District No. 1 of Snohomish County, Washington, et al., 128 S. Ct. 2733 (2008))
