EMPLOYEE PRIVACY IN THE INFORMATION AGE

The many changes in the law, the workplace and the very nature of work have certainly altered the landscape for employee privacy. Medical privacy is of course a significant issue for employers, but there are other areas where the rules and best practices are changing, including the following:

    • What employees have to be allowed to talk about
    • Employees’ use of personal mobile devices
    • Tracking employees’ whereabouts with GPS and other tools
    • Telecommuting – how much can you insist on knowing about what goes on in your employee’s home “workplace”?
    • Surveillance
    • Off-site behavior
    • And of course, social media – where should you look, and for what? 

We will use case studies to spark what we hope will be a lively discussion about these challenging issues.
